  What a catch22 our court systems are getting to be.  Me and the ex have discussed this and came to an agreement that our twins are better off with me. So we go and pick her up for court and go down there.  When we get there the lady asked me so why are we here today.  I told her that child protective services took the kids from her over two months ago and placed them with me, and that I'd like to have the custody switch to me so I could end the child support that I'm still be charged. (keep in mind the ex I and agree for 1 time).  The lady tells us Ok, I've set this matter up for a evidenciary hearing, you will recieve a copy of this judgement in the mail.   

  WTH., TWO PEOPLE ARE IN AGREEMENT,  WHAT MORE EVIDENCE DO YOU REALLY NEED.

  Well the evidenciary hearing was today and I think the ex pretty much hung herself.  She told lie after lie while I sat quiet and patient till my turn.  I told the truth, the whole truth, and nothing but the truth, which I was sworn to do.  The referee afterwards said that the next court date would be for her to speak with the twins.  After she speaks to the kids and does the math, I'm sure custody will be given to me.

  The twins knew I was going today, and asked 1st thing when they got home how it went.  I told them it went well and they have to go speak to the lady next.  My ex calls here almost every day and talks to the kids for a minimum of 30 mins, and I've told her she can come get them any day she wants, but they can't spend the night,  that is child protective services rule, not mine.  However she told the ref today I was not letting her see or talk to them.  Another thing the ref liked was the fact that both kids are on the honor roll now, and active in after school activities.  I may have screwded a lot of things up in my life, but raising my kids is something I've always done right.

I have had the kids since November, and I also had them all of last summer while out of school.  I am still being charged for child support.  I hav'nt paid since November, and they took it out of my taxes. The ref did say that was going to change after the next court date.

Its official,  got the paper work today.  Here are the findings.  Keep in mind, I am the Defendant.


A,  The love, affection, and other emotional ties existing between the parties involved and the child.

   The parties are equal

B.   The capacity and disposition of the parties involved to give the child love, affection and guidance and to continue the education and raising of the child in his or her religion or creed, if any.

   This factor favors the Defendant.  The children attend Church regularly

C.  The capacity and disposition of the parties involved to provide the child with food, clothing, medical care or other remedial care recognized and permitted under the laws of this state in place of medical care, and other material needs.

  The parties are equal

D.  The length of time the child has lived in a stable, satisfactory environment, and the desirability of maintaining continuity.

   This factor favor the Defendant.  The children were removed by CPS because of the Plaintiffs unsuitable housing.

E,  The permanence, as a family unit, of the existing or proposed custodial home or homes.

   This factor favors the defendant.  He is married and the Plaintiff is living with a boy friend.

F.  The moral fitness of the parties involved

   The parties are equal

G.  The mental and physical health of the parties involved.

   This factor favors the Defendant.  The Plaintiff receives SSi because she has a chemical imbalance for which she takes medication.

H.  The home, school, and community record of the child.

  This factor favors the Defendant.  The children are doing well in school.

I.  The reasonable preference of the child, if the court considers the child to be of sufficient age to express preference .

   This factor favors the Defendant

J.  The willingness and ability of each of the parties to facilitate and encourage a close and continuing parent child relationship between the child and the other parent or the child and the parents.

   The parties are equal.  The children cannot go to the plaintiffs home now so the parties worked out a plan for the plaintiff to have parenting time on Sunday afternoons.

K.  Domestic violence, regardless of whether the violence was directed against or witnessed by the child.

    This factor favors the Defendant.  The Plaintiff testified there was an incident of domestic violence between her and her boyfriend which required her to live with a relative for awhile.

L,  Any other factor considered by the court to be relevant to a particular child custody dispute.

   The children were removed from the Plaintiff because of housing issues.  They cannot go to her home overnight until she appropriate housing.



                                   RECOMMENDATION

It is the Recommendation of the referee that the following Order be entered with the Court.


IT IS HEREBY ORDERED that the parties shall continue to have joint legal custody of the minor children, and that the Defendant shall have physical custody of the children.

IT IS FURTHER ORDERED that until her home is appropriate for overnight parenting time, the Plaintiff shall have parenting time with the children on Sunday afternoons from 1pm until 6pm.

IT IS FURTHER ORDERED that the legal residence of the children shall not be changed to a location that is more than 100 miles from the child's legal residence at the time of commencement of the action in which the order is issued

IT IS FURTHER ORDERED that commencing on November 3, 2011, the Defendants child support obligation shall be suspended
