i dont think there will be any legal case its still not a fedral law and it would be like going to work drunk the employer has a right to fire or not hire

MORGZILLA!

You can't drink alcohol at work, you can't take a bunch of prescription painkillers at work, and i don't think that you should be able to come to work "medicated" out of your mind either.. i know a LOT of functional, legal smokers, and you can't tell when they have or havent medicated.. i think that the employer should hold the right to fire someone who comes to work high, or impaired because of smoking, but they shoudnt be able to fire someone because they are legal to smoke.. keep the medicating at home, and when you're at work, take a tylenol or something..

x3, just a tip, if you are a cardholder or plan to be, ask your employer how the policies apply.  as a manager, I would be a lot more likely to lobby to get you approved ahead of time for a positive drug test, then to get the explaination after you failed one.  JMO
