i got a tickit for 10,000 over wight yesterday been driveing for 10 years and frist  one D.O.T. had me pulled over for 1 1/2 hours did a hole truck inspeciom all past but no ideal how much the ticked will be any one else have one

last over weight ticket my dad got was like 1500 i think and a few points. p.o.s d.o.t. has been clamping down hard the last year or so. did they make you go to the scale or did he have the porta scale? if the porta scale you might beable to fight it as most of the time they are out dated and have not been calibrated.

this 10,000 over weight ticket is for your plate weight or gross? it must be for the plated weight. do you have pay it or dose some body else pay. the cheapest i have seen is $1.00 a pound, but that is doing frost laws.

ive seen them settle for a lower amount and stick em for the full amount also.  my uncle runs a bark hauling business around mi and ive seem 30000 pounds over tickets get settled for 5000$.  durring beet transfer season the usually sneak 100+tons in there trains

There's 3 ways you can get nailed:

plate,  state axle ratings, and GVWR.

Plates on the commercial truck must account for weight of any trailers being pulled too. We got nailed hauling our Posi Track with a chipper truck that had too light of a plate weight for the combination.



Did he make you do the inspection or did he perform it ?

Factory gvwr/gcwr/gawr established by VIN/info decal on the truck/owner's manual. And weight ratings on trailers.

They love getting 1/2 ton trucks with too heavy of a snowplow on them in the winter season too!

if it is for personal use and not registered with dot then really anything goes lol

I went to court over this and won, the dot rules and regs. are for commercial vehicles.

Laws have changed recently though. You don't have to have a DOT number on the truck, you barely have to have a name on it and they can nail you for the rules. There are other states that target personal-use haulers as well, you just don't see Michigan doing it as much.

yea that does suck  when did they change??? I was just in court last summer for it.

Take the cellphone law, for example just came into effect this January. My supervisors can be fined the commercial vehicle violation for their trucks solely because of the name on them. I'm talking a Dodge Dakota and Silverado 1500. They don't have DOT numbers on them, just the name.

That said, it's not safe to use a vehicle beyond its weight rating, any cop can nail someone for this if they feel like it. All you have to have is a light front end/improperly loaded trailer to get attention. DOT is ramping up enforcement this year, don't be surprised if more average Joes get pulled over. A lot is changing.


As for your case, they might have fined you for a violation under commercial vehicle code, and that's different. But you and I know DOT can pull anyone over, not just commercial vehicles.

yea dot can pull anyone over...there state police..... but if its just a personal vehicle Its quite ridicules that they would mess with ya, hell ive driven past numerous local and state boys with a 30' trailer stacked 4' high of scrap metal and bed of truck filled too.... driving on the bump stops lol  and never had a problem with em... I guess some cops just have something up their ass or had a bad day  sucks tho

I've gotten away with similar scrap-hauling adventures myself. Just depends on who it is.
